The Town of Cape Vincent Planning Board will hold a Public Hearing on Wednesday, June 10, 2020, at 7 p.m. at Recreation Park on So. James Street, Cape Vincent, to consider the application of Raymond Benjamin (Sand Bay LLC).

The applicant is requesting approval for a minor subdivision at 8353 County Route 9, Clayton, NY 13624 (tax map #29.16-1-39). The applicant is proposing to divide a 1.94-acre lot into 2 lots of 0.93- acres and 1.01-acres.

Public Hearing and Special Meeting Of The Cape Vincent Town Board May 7,

At a special meeting of the Town Board of the Town of Cape Vincent, held via the Zoom Meeting to be in compliance with the rules set forth by Governor Andrew Cuomo because of the Covid-19 Pandemic, on May 7, 2020, there were:

WHEREAS, by order of this Board dated April 16, 2020, a public hearing was scheduled for May 7, 2020, at 7:00 p.m., to consider the formation of a proposed water district to be known as Town of Cape Vincent Water District No. 7within the Town of Cape Vincent, pursuant to a certain map, plan and report prepared by Barton and Loguidice, D.P.C., for the proposed Town of Cape Vincent Water District No. 7 within the Town of Cape Vincent are dated August 2019, revised September 2019, and further revised April 2020, and filed with the Town Clerk, and

WHEREAS, the order scheduling the public hearing was duly posted and published as required by law, and on May 7, 2020, at 7:00 p.m., a public hearing was held to consider all persons interested in the formation of the proposed water district.

NOW, on motion duly made and seconded, this Board makes the following determinations:

1.         The notice of public hearing dated April 16, 2020, was duly published and posted as required by law, and is otherwise sufficient.

2.         All property and property owners to be benefited by the proposed water district are included within the limits of the proposed district. 

3.         All of the property owners and all of the property located within the proposed water district are benefited thereby. 

4.         The establishment of Town of Cape Vincent Water District No. 7 pursuant to the map, plan and report on file in the office of the Town Clerk, and upon which the public hearing was held on May 7, 2020, is in the public interest. 

5.         The establishment of the Town of Cape Vincent Water District No. 7 as described in the map, plan and report prepared by Barton and Loguidice, D.P.C., for the proposed Town of Cape Vincent Water District No. 7 within the Town of Cape Vincent are dated August 2019, revised September 2019, and further revised April 2020, the boundaries of which shall be as described on the attached Schedule “A”, is hereby approved.

6.         A Negative Declaration, Notice of Determination of Non-significance under the New York State Environmental Quality Review act was adopted by this Board as lead agency on August 14, 2019 and was properly filed, served and published.

7.         This Resolution is adopted subject to a permissive referendum.

8.         The Town Clerk is hereby directed to publish a copy of this Resolution in the official newspaper of the Town of Cape Vincent within ten (10) days of its adoption.

A motion to adopt the foregoing resolution was made by Councilman Wiley and second by Councilman Aubertine, and upon a roll call vote of the Board was duly adopted as follows:
